This is the third part of your Legal Issues and Liability Audit paper. In this section of your paper you will be writing about issues that arise from rule making and enforcing.
Conduct a review of policies and procedures pertaining to response and operations. Possible areas of discussion include:
Discipline: Misconduct on duty and off duty and ethical decisionmaking
Arbitration/mediation
The empowerment process, by which an agency receives its authority to make decisions and enforce them
The internal decisionmaking process, which is how the agency makes decisions
The accountability process, involving review by either the judiciary or elected officials
Codes in place and who has the power and responsibility to enforce them
Code enforcement inspection issues
Liability through adoption of codes
Liability through enforcement
Liability for failure to correct
Officer’s liability
SOP/SOG issues
Your paper should discuss at least 10 of the above potential topic areas. Include a review of the current policies and procedures related to these areas as well as, when appropriate, a review of how the policies and procedures are being applied. Explain the legal concerns in each area and your recommendations on changes, if any, or statement that they are acceptable the way they are. Your paper for this section should be at least 5 pages long.
